Please review the following basic terms that govern your use of, and purchase of, products from our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms (the “Agreement”)
GENERAL:
We may change the terms that govern your use of our Site. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We may change, add, move or delete portions of our Site from time to time.
PRODUCT AVAILABILITY:
Although availability may be indicated on the Site, we cannot guarantee product availability and products if we are out of stock on an item that has sold out. We reserve the right, without liability or prior notice, to revise, discontinue, or cancel an order.
SHIPPING & HANDLING:
Orders are processed within 48 hours of receipt Monday through Friday, excluding holidays. Orders received on weekends and holidays will be processed the next business day. Please make sure you double check your billing and shipping address Kimberly Baker is not responsible for rerouting packages.
Orders are processed from Seattle .WA.
Availability of products is not guaranteed. If you have ordered an item that is not available or that is delayed, we will notify you via email or telephone.
For all shipments within the U.S., buyer is given the option of FedEx Ground, Express Saver (2-3 Day), 2 day, or Overnight. Buyer will receive a shipment confirmation email with the shipping tracking number. Signature required.
Residents of Washington will pay state tax on their purchase (9.25%)
INTERNATIONAL:
International orders will be shipped via Fed Ex International economy. Expected arrival date for international orders is approximately 10-14 days from the order date. Buyer will receive a shipment confirmation email with the shipping tracking number.
For international orders, a customs duty will be charged to you depending upon the country in which you reside Kimberly Baker is not responsible for payment of this duty.
CUSTOM ORDERS:
If you need a ring in another size or would like a necklace in a custom length please email orders@kimberlybaker.com for customizing questions and prices.
All sales on custom items are final.
REPAIRS:
We will repair any damaged products without charge for the items purchased through kimberlybaker.com with-in 6 months of purchase without a fee. Repairs for items that have been more than 6 months, will have a fee depending on what the piece needs to have done to fix it. Please email orders@kimberlybaker.com for specifications.
REFUNDS:
We want you to be completely happy with your purchase. If you are unsatisfied for any reason, please return your purchase within fifteen (15) business days of receipt of goods for an item that is of equal or lesser value than the item purchased. We do not offer credit card refunds. We have the right to deny a refund if the merchandise returned does not meet our return policy requirements.
All sale items are final sale no returns or exchanges.
Prior to shipping your return, you must first obtain a return authorization code, please email orders@kimberlybaker.com with your request. All returns must be in the original packaging and be shipped prepaid and insured via UPS Ground at the cost of the customer. We are not responsible for lost items and cannot issue credit for lost items deemed the fault of Fed Ex.

DAMAGED GOODS:
If, upon receipt, you find that your order is not as it should be, please contact us immediately orders@kimberlybaker.com for a return authorization number. Any damage must be reported within ten (10) days of delivery. We will gladly cover the cost of shipping the damaged goods and replacing them with a new piece once we receive the order back form you.
SALES TAX:
State sales tax 9.25 % will apply to all orders shipped to addresses within the state of Washington.
LOST PACKAGES:
In the instance that you feel a package has been lost please contact Fed Ex then contact us using either the tracking number for Fed Ex or customs number for Fed Ex provided in an email upon confirmation of the outbound shipment.
USER COMMENTS, FEEDBACK, POSTCARDS AND OTHER SUBMISSIONS:
All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Kimberly Baker on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively, “Comments”) shall be and remain Kimberly Baker’s property. Such disclosure, submission or offer of any Comments shall constitute an assignment to Kimberly Baker of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, Kimberly Baker will own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Kimberly Baker is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay to user any compensation for any Comments; or (3) to respond to any user Comments.
You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no Comments submitted by you to the Site will be or contain libelous or otherwise unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any Comments you make.
By participating in Site sweepstakes, contests, promotions, and/or requesting promotional information or product updates, you agree that Kimberly Baker may use your information for marketing and promotional purposes.

The following policies apply solely to kimberlybaker.com and to those who use this site; the policies do not extent to any other web site or business that may be linked to mentioned or affiliated with kimberlybaker.com.
PAYMENT INFORMATION:
Customer are not required to create an account in order to access and shop online at kimberlybaker.com, however you are required to provide specific personal information for processing payment and the shipment of purchased items. The information you provide pertains to your name and billing address associated with the card used in the purchase and the shipping information for the order. Any information retained by kimberlybaker.com and Kimberly Baker Jewelry is only used to process payment, ship your order and contact you regarding your order if necessary.

If such is the case, we may reject your order or call you at the phone number you provided to confirm your order and or personal information. We also reserve the right to cancel any account or refuse to ship to certain addresses due to suspected fraud or illegal activity. This is done for the protection of you the customer as well as Kimberly Baker Jewelry and kimberlybaker.com. If any order is canceled based on suspicion of fraud or illegal activity, any payment received and processed at that time will be returned to the credit account used in the purchase.

Kimberly Baker also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in Kimberly Baker’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or Kimberly Baker, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
